Minutes of the Public Hearing and Regular Monthly Meeting of the Santa Clara Town Board held on Thursday, August 9, 2018, Saranac Inn, NY Town Hall at 6:45 P.M.

Public Hearing

Called to order by Supervisor Webb at 6:45 P.M. on the proposed Local Law No. 2 of 2018. The proposed Local Law would abolish the elective office of Town Highway Superintendent effective at the end of the day on December 31, 2018 and create the appointed position of Town Highway Superintendent effective as of January 1, 2019. It would specifically supersede Town Law §20 with respect to election of the Town Highway Superintendent in its application to the office of Highway Superintendent of the Town of Santa Clara. If the Local Law is adopted by the Town Board, it will be subject to mandatory referendum at the November, 2018 general election.

All those wishing to make oral or written comments having been heard, the Public Hearing was adjourned at 6:55 P.M. on the motion of Rick Lyon, seconded by Dave Perry. All members voting Aye. Motion carried.

Regular Meeting

Motion by Rick Lyon, seconded by Dave Perry to dispense with the reading of the minutes of the previous meeting. All members voting Aye. Motion carried. Motion by Rick Lyon, seconded by John Murray to accept the minutes. All members voting Aye. Motion carried.

RESOLUTION ADOPTING PROPOSED LOCAL LAW NO. 2 OF 2018 ABOLISHING THE ELECTED OFFICE OF TOWN HIGHWAY SUPERINTENDENT AND CREATING THE APPOINTED POSITION OF TOWN HIGHWAY SUPERINTNENDENT

WHEREAS, the Santa Clara Town Board is considering adoption of Local Law No. 2 of 2018 to provide that the office of Town Highway Superintendent will be appointed rather than elected commencing January 1, 2019; and
WHEREAS, this legislation is authorized under New York Municipal Home Rule Law §10; and
WHEREAS, Municipal Home Rule Law §20 requires the Town Board to hold a Public Hearing prior to the adoption of any Local Law, and the Town Board duly held a Public Hearing on Thursday, August 9, 2018 concerning proposed Local Law No. 2 of 2018 and heard all interested persons; and
WHEREAS, the proposed Local Law is in a form approved by Town Counsel; NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF SANTA CLARA, FRANKLIN COUNTY, NEW YORK, AS FOLLOWS:
1. The Town Board hereby adopts proposed Local Law No. 2 of 2018 which would abolish the elective office of Town Highway Superintendent effective at the end of the day December 31, 2018 and create the appointive office of Town Highway Superintendent effective as of January 1, 2019.
2. Local Law No. 2 is adopted subject to mandatory referendum, and the Town Board hereby authorizes and directs the Town Supervisor, Town Clerk and/or Town Counsel to take such actions as necessary to submit the Local Law to mandatory referendum at the November 6, 2018 general election.
3. The Town Board hereby authorizes and directs the Town Clerk to file the Local Law with the New York State Secretary of State in accordance with the provisions of the Municipal Home Rule Law if it is approved by the electors.
4. The Town Board authorizes and directs the Town Supervisor, Town Clerk and/or Town Counsel to execute any required documents and take any and all actions necessary to effectuate the intent of this Resolution. The question of the adoption of this Resolution by the Santa Clara Town Board was duly put to a vote on roll call and it was declared duly adopted.

Paul Smiths Gabriels Fire Department Chief Dan Whitson gave a brief report of the changes and additions to their fire department. Dan also presented the Town Board with a proposed contract for fire coverage for 2019. The Board will review it and advise the department of their decision

FEMA- The Federal Emergency Management Agency held a meeting in the community room on July 25, 2018. Councilman Dave Perry and Guy Middleton attended this meeting. It was a discovery meeting to determine potential issues with the waterways, dams and flooding in the Saranac Lake Watershed areas. Michelle Brown Garcia asked if there were any dams located in Santa Clara. There is one dam located in the Hamlet of Santa Clara.

Town Hall/Pole Barn - Jon Hutchins inspected the surface cracks in the walls of the Town Hall and Jon had his employees repaired the cracks and repainted the areas. Jon is still researching why the wall in the community room had such a deep crack. Andy Abdallah, the engineer for the building, is also still researching the issue of the deep crack in the community room wall. Andy Abdullah is also drawing up plans for a Pole Barn for the highway department to use for cold storage.

Open Discussion

Bruce McLanahan discussed the Public Service Commission revoking Charter Communications/Spectrum’s right to provide internet/cable/telephone service in New York State. Charter was given 60 days to transfer the services to a new company. Bruce advised now is a good time for the town to leverage getting service to areas of the Town that do not currently have it. The areas identified are the Hamlet and Bartlett Carry Road. Michelle Brown Garcia is going to check to see if all of Gilpin Bay Road has coverage. If not, that area can be added to the list. Supervisor Webb asked Bruce to draft a letter to the Public Service Commission on behalf of the Town.

Good of the Town

Resolution No 12

On a motion by Rick Lyon, seconded by John Murray set a speed limit of 35 Miles Per Hour between the end of the Keese Mills Road and the end of the pavement on Blue Mountain Road in the Town of Santa Clara.

Highway Superintendent McGill is checking with the County again about getting the portal speed sign put on the County road. The summer traffic to the golf course and boat launch needs to be reminded to slow down. Michael Martin of Cedar Eden will be doing the annual inspection of the landfill on August 12, 2018. The landfill will be mowed again next week. The County will not be stripping the roads at this end of the county until September or October.

September Board meeting date change. Due to the Primary Elections being on Thursday September 13, 2018 the regular board meeting will be moved to Tuesday September 11, 2018.

General Fund vouchers No. 172 to 191 in the amount of $7,154.41 and Highway Fund vouchers No. 71 to 78 in the amount of $1,993.83 were audited by the Board. Motion by Rick Lyon seconded by John Murray to approve vouchers and pay audited vouchers. All members voting Aye. Motion carried.
