Minutes of the Regular Monthly Meeting of the Santa Clara Town Board held on June 19, 2019 Saranac Inn, NY Town Hall at 7:00 P.M.

Monthly meeting called to order at 7 P.M. by Supervisor Webb.

Motion by Rick Lyon, seconded by John Murray to dispense with the reading of the minutes of the previous meeting. All members voting Aye. Motion carried. Motion by John Murray, seconded by Dave Perry to accept the minutes. All members voting Aye. Motion carried.

Resolution No 8
RESOLUTION SCHEDULING PUBLIC HEARING ON PROPOSED LOCAL LAW NO.1 OF 2019 A LOCAL LAW PROVIDING THAT THE APPOINTED HIGHWAY SUPERINTENDENT OF THE TOWN OF SANTA CLARA NEED NOT BE A RESIDENT OR ELECTOR OF THE TOWN OF SANTA CLARA.

WHEREAS, the Santa Clara Town Board is considering adoption of Local Law No.1 of 2019 to provide that the office of Town Highway Superintendent will allow a person who is a resident of Franklin County, Essex County or St. Lawrence County, New York to serve as the appointed highway superintendent of the Town of Santa Clara WHEREAS, Municipal Home Rule Law §20 requires the Town Board to hold a Public Hearing prior to the adoption of any Local Law; NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF SANTA CLARA, FRANKLIN COUNTY, NEW YORK, AS FOLLOWS:

1. The Town Board shall meet on Thursday, July 18, 2019 at 6:30 PM to hold a Public Hearing to hear and receive comments from all people who are interested in proposed Local Law No.1 of 2019 which would allow a person who is a resident of Franklin County, Essex County or St. Lawrence County, New York to serve as the appointed highway superintendent of the Town of Santa Clara.

2. The Town Clerk is hereby authorized and directed to publish a Notice of Public Hearing in the Adirondack Daily Enterprise not less than five (5) days before the date of the Public Hearing and to make a copy of the proposed Local Law available at no charge to anyone who requests it.

3. This Resolution shall take effect immediately . The question of the adoption of this Resolution by the Santa Clara Town Board was duly put to vote on roll call and it was declared duly adopted.

Land Use Code Update - Proposed Local Law 02-2019 updating the Town Land Use Code will need to have another public hearing as the Town’s legal counsel has advised the proper steps where not followed in April.

RESOLUTION SCHEDULING PUBLIC HEARING ON PROPOSED LOCAL LAW AMENDING THE TOWN OF SANTA CLARA LAND USE CODE AND OFFICIAL TOWN OF SANTA CLARA LAND USE MAP WITH RESPECT TO DOCKS, BOATHOUSES AND OTHER WATERFRONT STRUCTURES, AND BOUNDARY LINE ADJUSTMENTS, SUBDIVISION FILING REQUIREMENTS, NON-CONFORMING LOTS AND RE-ZONING THE PARCEL IDENTIFIED AS TAX MAP PARCEL 453.3-1-1.300, ETC.

WHEREAS, the Santa Clara Town Board (the "Town Board") is considering adoption of a Local Law amending the Town’s Land Use Law and the official Town of Santa Clara Land Use Map with respect to docks, boathouses and other waterfront structures, and boundary line adjustments, subdivision filing requirements, non-conforming lots and re-zoning the parcel identified as tax map parcel 453.3-1-1.300, and other matters, and

WHEREAS, the Town Board has reviewed a draft of a Local Law which, if adopted, would effectuate the various changes and amendments being considered by the Town Board, and

WHEREAS, the Town’s Land Use Code requires referral of proposed Code amendments to the Town’s Planning Board for its review and a report to the Town Board prior to adoption of such amendments by the Town Board, and

WHEREAS, New York State Municipal Home Rule Law Section 20 requires the Town Board to hold a public hearing prior to the adoption of a Local Law, and

WHEREAS, New York State General Municipal Law requires that proposed amendments to the Town’s Land Use Code with Town-wide applicability be referred to regional planning agencies and adjoining towns for review and comments prior to adoption,

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF SANTA CLARA, FRANKLIN COUNTY, NEW YORK, AS FOLLOWS:

Section 1: SEQRA - The Town Board hereby finds that adoption of the proposed Local Law will require review under the State Environmental Quality Review Act (SEQRA) and authorizes preparation of Part 1 of the required SEQRA Environmental Assessment Form ("EAF").

Section 2: Referral to Planning Board – The Town Board hereby refers the draft Land Use Code amendments reviewed by the Town Board at its meeting on this date to the Town’s Planning Board for its review and report to the Town Board in accordance with Section 12.10 of the Town’s Land Use Code.

Section 3: Public Hearing; Notice - The Town Board shall meet on Thursday, July 19, 2019 at 6:45 PM to hold a Public Hearing to hear and receive comments from all people who are interested in proposed Local Law No. 02 of 2019 which would amend the Town’s Land Use Code and official Town of Santa Clara Land Use Map with respect to docks, boathouses and other waterfront structures, and boundary line adjustments, subdivision filing requirements, non-conforming lots and re-zoning the parcel identified as tax map parcel 453.3-1-1.300, and other matters. The Town Clerk is hereby authorized and directed to publish a Notice of Public Hearing in the Adirondack Daily Enterprise not less than ten (10) days before the date of the Public Hearing. The Town Clerk is also authorized and directed to make a copy of the proposed Local Law available at no charge to anyone who requests it.

Section 4: Service of Written Notice - The Town Clerk is hereby further authorized and directed to: 1) refer the proposed amendments for review and comments as provided in Article XII of the Town Land Use Code, 2) to cause written notice of the Public Hearing on the proposed amendments to be given as provided in Article XII of the Town Land Use Code, and as may otherwise be required pursuant to New York State law, and 3) to make any other referrals and provide any other notices with respect to the proposed amendments as may be recommended by the Town’s Special Counsel.

Section 5: Assistance of Special Counsel – The Town’s Special Counsel for planning and zoning matters; the law firm of Miller, Mannix, Schachner & Hafner, LLC; is hereby authorized and directed to assist the Town Clerk, Planning Board, Code Enforcement Officer and Town Board with the preparation of any and all documents necessary for the adoption of proposed amendments to the Town’s Land Use Code and to otherwise advise and assist Town officials in the process of adopting such amendments.

Section 6: Effective Date - This Resolution shall take effect immediately. The question of the adoption of this Resolution was duly put to a vote on roll call which resulted as follows:

Cold Storage Building for Highway Department – The architect has prepared the bid specifications and they were published in the Press Republican and the Adirondack Daily Enterprise. The bids will be opened on July 1, 2019 at the Town of Santa Clara Town Hall.

Meeting Date Change- Reminder that the July Board Meeting date has changed to Thursday July 18, 2019 at 7 P.M.

Open Discussion

Andrew McGill, the Town’s Safety Officer, thanked the Board for sending him to the PERMA 2019 Basic and Advanced Safety Coordinator Training.

Guy Middleton reported that Franklin County Soil and Water will hold an Invasive Species Workshop July 10, 2019, at the Tupper Lake Community Room.

Good of the Town

Planning Board- On a motion by Rick Lyon, seconded by John Murray the Board appointed John LaHart as Vice Chair of the Town Planning Board. All members voting Aye. Motion carried.

Highway Superintendent Scott LaMay reported that the new loader has been ordered from Tracey Road Equipment. Beauregard was the original choice but when the contract was received and reviewed there were items and prices listed that were not in the original quote and the Town would not sign the contract. Road sand and salt have been put up for this winter. The Trim Hill Road in the Hamlet has come close to washing out due to beaver dams. Nuisance Pest Control has been contacted to take care of the issue. Lubrication Engineers has done a 9% increase on all oil and fuel additives. Scott will be looking for another supplier. Scott has been in contact with Hyde Fuel Company to see about moving the diesel and gas tanks. They need to be move to a better location with the new cold storage building coming. Scott reported that the 6 ½ ton weight signs were removed from the Floodwood Bridge by the State of New York and replaced with 18 ton weight signs. As the Town owns that bridge, the State should have come to the Town before the signs were changed. Scott and the Board are concerned that damage will be done to the bridge that the Town not too long ago had rebuilt. A letter was sent to NYS DOT Region 7 advising them of the Town‘s position that the change could result in both the bridge and road becoming dangerous with rapid deterioration of the road.

General Fund vouchers No. 127 to 156 in the amount of $12,454.91 and Highway Fund vouchers No. 39 to 47 in the amount of $2,997.50 were audited by the Board. Motion by Rick Lyon seconded by Dave Perry to approve vouchers and pay audited vouchers. All members voting Aye. Motion carried.
