TOWN OF SANTA CLARA PUBLIC HEARING AND REGULAR MEETING

Minutes of a Public Hearing of the Santa Clara Town Board held on Thursday, November 9, 2017, Saranac Inn, NY Town Hall at 6:45 P. M.

Public Hearing on the proposed Saranac Lake Volunteer Rescue Squad, Inc. contract was convened at 6:45 P.M. by Supervisor Webb. The new contract with the Saranac Lake Volunteer Rescue Squad, Inc. is for the furnishing of pre-hospital emergency medical care and transport ambulance services of the sick and injured within the borders of the Town. The proposed contract states that its term shall be for a period of one year commencing January 1, 2018 and terminating December 31, 2018 and that the amount to be paid by the Town to the Saranac Lake Volunteer Ambulance Squad, Inc.for providing such services shall be $27,849.00.

Saranac Lake Volunteer Rescue Squad, Inc. will cover the Keese Mill Road/Bay Pond area and from the Fish Hatchery Road to Moss Rock Road.

All those wishing to make oral or written comments having been heard, the Public Hearing was adjourned at 6:59 P.M. on the motion of Tom Kimpton, seconded by Rick Lyon. All members voting Aye. Motion carried.

Regular monthly meeting called to order by Supervisor Webb. Motion by Tom Kimpton, seconded by Dave Perry to dispense with the reading of the minutes of the previous meeting. All members voting Aye. Motion carried. Motion by Rick Lyon, seconded by Dave Perry to accept the minutes. All members voting Aye. Motion carried.

Resolution No 16: Saranac Lake Volunteer Rescue Squad, Inc. contract

Open Discussion

Guy Middleton has looked into the request by Highway Superintendent McGill to remove the old mats used for milfoil collection that are stored at the Town. Guy is reaching out to other groups who may be in need of the mats and inquiring if they want them. It may be spring before the mats are removed.

Rick Lyon stated that several long time Town residents were unable to vote on November 7th as they were not listed in the voter registry as a Town resident. Michelle Brown Garcia stated the same thing happened to her at the last Saranac Lake School Board election. After further discussion on the issues with the Franklin County Board of Election office, it was determined that anyone in Franklin County having issues should write a letter of complaint to the Franklin County Manager, Donna Kissane.

Resolution No 17: Snow Ice Removal Contract with Franklin County

THIS AGREEMENT made and entered into the 30 day of October,2017 by and between BRADFORD MARSH, Superintendent of Highway for the County of Franklin, hereinafter referred to as "the County" and ANDREW J MCGILL., Superintendent of Highways for the Town of Santa Clara, hereinafter referred to as "the Town."
WHEREAS: the Franklin County Board of Legislators did, on the 19th day of October, 2017 authorize the Superintendent of Highways for the County of Franklin, pursuant to Section 135-a of the Highway Law of the State of New York, to enter into an agreement with any of the Towns of the County of Santa Clara for the removal of snow and the sanding of County highways within the respective town by any town that desires, and
WHEREAS: the Town Board of the Town of Santa Clara, Franklin County, New York did by Resolution dated the 9 day of November 2017 authorize the Town Superintendent of Highways to enter into such an agreement for the removal of snow and sanding of County highways within the said Town of Santa Clara.
WHEREAS: It is mutually agreed as follows:

The Town of Santa Clara has the following miles herein they agree to remove snow from, and to sand, the County highways within said Town whenever snow or ice conditions exist on said highways which warrant the control of snow and ice on the highways for the following years:

2017-2018: CR 18,46 1.07 miles @ $5,992.00
2018-2019: CR 18,46 1.07 miles @ $6,111.84
2019-2020: CR 18,46 1.07 miles @ $6,203.52

2. The Town herein agrees to furnish, maintain and operate their own equipment and supplies for the adequate removal of snow from, or sanding of, said County

highways.

3. In case of a difference of opinion between said Town and County as to whether conditions existing necessitate the removal of snow from, or sanding of, said County highways, the County Superintendent of Highways shall be the sole judge.

4. If the Town refuses to remove snow from, or to sand, County highways when requested by the County Superintendent of Highways, the County Superintendent may remove said snow from, or sand, said highways and the cost of doing so shall be deducted from any amount of monies due and owing the said Town under this contract.

5. Payment shall be made to the Town upon presenting a verified voucher to the County Superintendent of Highways who will, in turn, present to the same to the County Treasurer for payment. Payment to the Town shall be made as follows:1/2z to be paid February 15,2018, and the balance to be paid by July 15,2018, then the 2nd year, 1/2 to be paid by February 15,2019, and the balance to be paid by July 15,2019. The 3rd year, 1/2 to be paid by February 15,2020, and the balance to be paid by July 15,2020.

6. In addition to the above, the per year rate shall be modified from time to time according to the following adjustments a. Market Price Diesel Fuel. On November 1,2018, November 1,2019 & November 1,2020, the base price for # 2 low Sulphur diesel fuel will be determined by either New York State Office of General Services COGS) contract or by the lowest responsible bidder that is acceptable to Franklin County. Each January 1 st and September 30th, the NYSOGS contract price for #2 diesel shall be compared to the base price. For each .50 cent difference between the prices, the payment per mile shall be increased/decreased $100.00 per mile per year. If the price difference is less than 50 cents, there shall be no adjustment.

7. That this agreement is effective during the calendar years of 2018, 2019 & 2020.

On a motion by Dave Perry seconded by Tom Kimpton the Board accepted and approved the contract.

ADOPTED: Ayes 4. Nays 0. Absent 1 Murray.

Supervisor Webb received a letter from the Town of Waverly Food Pantry. On a Motion by Tom Kimpton, seconded by Rick Lyon the Board agreed to make a donation to the Waverly Food Pantry in the amount of $400.00. All members voting Aye. Motion carried.

General Fund vouchers No. 264 to 290 in the amount of $10,652.44, and Highway Fund vouchers No. 106 to 119 in the amount of $5,190.07 were audited by the Board. Motion by Rick Lyon seconded by Dave Perry to approve vouchers and pay audited vouchers. All members voting Aye. Motion carried.

Motion to adjourn at 7:40 P.M. made by Dave Perry, seconded by Rick Lyon. All members voting Aye. Motion carried.
