Minutes of a Public hearing and the Regular Monthly Meeting of the Santa Clara Town Board held on Thursday, October 11, 2018, Saranac Inn, NY Town Hall at 6:30 P.M.

Public Hearing: Called to order by Supervisor Webb at 6:30 P.M. on the Preliminary Budget of the Town of Santa Clara for the fiscal year beginning January 1, 2019. A copy of it is available at the office of the Town Clerk at the Santa Clara Town Hall, 5367 State Route 30, Saranac Inn, NY, where it may be inspected by any interested person during office hours.

Pursuant to Section 108 of the Town Law the following proposed salaries of the following Town Officials are specified in said Preliminary Budget:

Supervisor: $15,422.00
Councilman (4): $3,215.75 each
Town Clerk: $11,968.00
Tax Collector: $3,737.00
Town Highway Superintendent: $46,481.00
Town Justice: $4,701.00

All those wishing to make oral or written comments having been heard, the Public Hearing was adjourned at 6:55 P.M. on the motion of Tom Kimpton, seconded by Dave Perry. All members voting Aye. Motion carried.

Regular Meeting called to order at 7 P.M. by Supervisor Webb.

Motion by Tom Kimpton, seconded by Dave Perry to dispense with the reading of the minutes of the previous meeting. All members voting Aye. Motion carried. Motion by Rick Lyon, seconded by John Murray to accept the minutes. All members voting Aye. Motion carried.

Resolution No 13 2019 Town of Santa Clara Budget

Budget of the Town of Santa Clara for the fiscal year beginning January 1, 2019.

Pursuant to Section 108 of the Town Law the following proposed salaries of the following Town Officials are specified in said Budget:

Supervisor: $15,422.00
Councilman (4): $3,215.75 each
Town Clerk: $11,968.00
Tax Collector: $3,737.00
Town Highway Superintendent: $46,481.00
Town Justice: $4,701.00

On a motion by John Murray, seconded by Dave Perry the Board adopted the 2019 budget.

RESOLUTION SPECIFYING DETAILS OF TOWN OF SANTA CLARA SPECIAL ELECTION

WHEREAS, the Santa Clara Town Board has adopted Local Law No. 2 of 2018 which would abolish the elective office of Town Highway Superintendent effective at the end of the day December 31, 2018 and create the appointed position of Town Highway Superintendent effective as of January 1, 2019; and
WHEREAS, the Local Law is subject to mandatory referendum; and
WHEREAS, all Town elections held at any time other than the Tuesday next succeeding the first Monday in November of every odd-numbered year are Special Elections; and
WHEREAS, New York Town Law requires the Town Board to adopt a Resolution designating the hours of opening and closing the polls and the place or places of holding a Special Election, and setting forth in full all propositions to be voted upon;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

1. A Special Election of the electors of the Town of Santa Clara is hereby authorized and directed to be held at the same time and place as the General Election on November 6, 2018, between the hours of 6:00 A.M. and 9:00 P.M., for the purpose of voting on the proposition hereinafter set forth.
2. The polling place for the Special Election is hereby designated as the same polling place as for the General Election, which is Town Hall, 5367 State Route 30, Saranac Inn, New York 12983.
3. The Notice of Special Election shall be in substantially the following form:

NOTICE OF SPECIAL ELECTION TOWN OF SANTA CLARA Franklin County, New York

NOTICE IS HEREBY GIVEN that pursuant to Resolution of the Santa Clara Town Board a Special Election of the electors of the Town of Santa Clara will be held at the same time and polling place as the General Election on November 6, 2018, between the hours of 6:00 A.M. and 9:00 P.M, to vote upon the following proposition:

PROPOSITION NO. 1
Shall there be approved in the Town of Santa Clara Local Law No. 2 of 2018, entitled “A Local Law Abolishing the Elected Office of Highway Superintendent and Creating the Appointed Position of Highway Superintendent of the Town of Santa Clara” as adopted by the Santa Clara Town Board on August 9, 2018? The polling place for the Special Election is the same polling place as for the General Election, which is Town Hall, 5367 State Route 30, Saranac Inn, New York 12983. Every elector of the Town of Santa Clara, Franklin County, New York, shall be entitled to vote on the proposition. A complete copy of the Local Law may be obtained from the Town Clerk.

4. The Town Clerk is hereby authorized and directed to give notice of the Special Election by publication of the Notice in the Adirondack Daily Enterprise at least ten (10) days prior to the date of the Special Election, and by posting a copy of the Notice on the sign board of the Town at least ten (10) days before the Special Election.
5. The Town Board authorizes and directs the Town Supervisor, Town Clerk and Town Counsel to coordinate with the Franklin County Board of Elections and to execute any required documents and take any and all actions necessary to effectuate the intent of this Resolution. The question of the adoption of this Resolution by the Santa Clara Town Board was duly put to a vote on roll call and it was declared duly adopted this 11TH day of October, 2018.

Resolution No 15 Settlement offer on the Young property for the assessment to be $1,000.00 an acre. Motion by Rick Lyon, seconded by John Murray to accept the settlement offer of $1,000.00 an acre.

Open Discussion

Scottie Adams reported that the Planning Board has been working on updating the Land Use Code and the Land Use Map. The Planning Board is ready to present the changes to the Town Board. A Public Hearing will then be set for the public to comment on the changes before the changes can be adopted by the Board.

John LaHart reported that the fire truck for the Town of Santa Clara substation is out of service. If the volunteers need to respond, they have no truck available. John Briaddy stated the heater core is broke. The 1983 truck is operable but does not meet all the requirements and there is a liability issue with the pump not working properly. Tupper Lake Volunteer Fire Department claims it will cost approximately $4,000.00 to repair the truck and they do not have the funds. Scottie Adams advised that the Santa Clara Volunteers have had to date 17 training sessions and want a better truck available to them. Supervisor Webb will look into the issues with the Village of Tupper Lake and get back to the Santa Clara Volunteers.

Good of the Town

Highway Superintendent McGill reported that the new 2019 Ford truck has arrived. The plows and sanders are on the big trucks and ready for winter.

Supervisor Webb has received the contract from the Tri-Lake Humane Society for 2019.

Resolution No 16

Tri-Lakes Humane Society Animal Control Contract for 2019 at a price of $892.00. Motion by Rick Lyon, seconded by Tom Kimpton to accept the 2019 contract for $892.00.

Friends of Eagle Island were given a 2 year time limit to complete all restoration. Supervisor Webb stated that Mike Hill, Town Counsel, advised that Friends of Eagle Island may not be able to complete the restoration within this time period due to red tape and water and sewer issues and they may need an extension. Supervisor Webb advised that Friends of Eagle Island will need to formally request an extension giving a time frame and a list of the reasons requiring this extension.

General Fund vouchers No. 215 to 235 in the amount of $31,271.60 and Highway Fund vouchers No. 90 to 100 in the amount of $77,826.18 were audited by the Board. Motion by Tom Kimpton seconded by Rick Lyon to approve vouchers and pay audited vouchers. All members voting Aye. Motion carried.
