Minutes of the Regular Monthly Meeting of the Santa Clara Town Board held on Thursday, October 13, 2016, Saranac Inn, NY Town Hall at 7:00 P.M.

Regular monthly meeting called to order by Supervisor Webb. Motion by Tom Kimpton, seconded by Phil Durkin to dispense with the reading of the minutes of the previous meeting. All members voting Aye. Motion carried. Motion by Phil Durkin, seconded by Dave Perry to accept the minutes. All members voting Aye. Motion carried.

Resolution No. 14

Local Law No. 03 of 2016 entitled "A Local Law to prohibit the parking of vehicles on certain town highways." ALL AYE.

A Local Law to prohibit the parking of vehicles on certain town highways.

    Section 1. Findings and Purpose

    The Town Board of the Town of Santa Clara finds that certain town highways at times become congested with parked vehicles, which interfere with the free flow of traffic along said highways and with the ability of the town to properly maintain and plow snow from them. Such parking therefore poses an imminent threat to the peace, good order, safety and welfare of the public. The purpose of this local law is to promote the welfare of the general public by prohibiting parking of vehicles on such town highways so as to assure that they are free from obstructions and open for unrestricted travel.

    Section 2. Authority

    This local law is enacted pursuant to the authority granted to the Town Board by Town Law Sections 130 (7) and135 (2) concerning regulating the use of public places and restricting the parking of vehicles therein, and the imposition of fines for violations.

    Section 3. Prohibition of parking

    No person shall park or leave, or cause to be parked or left, at any time of the day or night, any motor vehicle, snowmobile or special and/or limited use vehicle (also denominated as "all terrain vehicles") upon the following town highways:

      a) Moss Rock Road, Hoel Pond Road or Beaverwood Road.

      b) The westerly termination of Floodwood Road at the Town line.

      c) The Back Bay Spur or Back Bay Road from the intersections of County Route 46 to the start of Saranac Inn Lane.

    Section 4. Signs

    The Town Board may cause to be erected suitable signs stating that such parking is prohibited. When such signs have been posted prohibiting the parking of such vehicles no person shall park any vehicle in violation of the restriction stated on such signs.

    Section 5. Enforcement

    It shall be the duty of all authorized peace officers and of any police officer of New York State or Franklin County to enforce the provisions of this local law, and to make arrests or issue summonses or other legal process for violation of the provisions of this local law.

    Section 6. Penalties for offenses

    In addition to any other remedy for an offense against this local law, a person violating any of its provisions shall be guilty of a violation, and upon conviction thereof shall be punishable by a fine of not more than $50.00 for each offense, or by imprisonment for not more than 15 days, or by both such fine and imprisonment.

This local law shall become effective upon its being filed with the New York State Department of State.

New Building Sign

Rick Lyon reported that the sign is in production but has no completion date. On a motion by Rick Lyon, seconded by Phil Durkin the Board authorized Supervisor Webb to purchase a sign for the new Substation. The sign will read Town of Santa Clara Substation of the Village of Tupper Lake Volunteer Fire Department. All members voting Aye. Motion carried. Supervisor Webb wanted to commend Chief Carl Steffan and Mayor Paul Maroun for all the work done to make this substation possible.

DEC Recreation Trail Update

Supervisor Webb was unable to attend the last 2 meetings therefore he had nothing to report.

Friends of Eagle Island

The Town of Santa Clara Planning Board provided the Town Board with a report on Friends of Eagle Islands request to amend the Town Land Use Code. On a motion by Phil Durkin, seconded by Rick Lyon the Town Board accepted the Report from the Planning Board. All members voting Aye. Motion carried. On a motion by Phil Durkin, seconded by Dave Perry the Board set a date for the Public Hearing on the proposed amendment to the Town Land Use Code for Thursday, December 8, 2016 at 6 P.M. All members voting Aye. Motion carried. Supervisor Webb thanked Scottie Adams and the rest of the Planning Board for their hard work in completing this report.

November Board Meeting

The November Board Meeting has been changed from November 10 to the 17th.

Speed Limit on County Route 46

In August the Board received a letter from Mr. and Mrs. Matthew Hudson requesting a change of the speed limit on County Route 46 from 35 M.P.H. to 25 M.P.H. Supervisor Webb has sent a letter to the Franklin County Highway Superintendent and Franklin County Traffic Safety Board advising them of this request. The Town Supervisor and the Franklin County Highway Superintendent are now receiving letters from Town residents due to a letter writing campaign by Mr. Hudson requesting this change. New York State Law DOES NOT ALLOW the Town to change speed limits. As County Route 46 is a County road, the Franklin County Highway Superintendent must file paperwork with the State Of New York requesting approval to change the speed limit. Supervisor Webb will follow up on the status of this request.

Open Discussion

Bob Goodell, Attorney for Friends of Eagle Island advised the Board if they required any further information to let him know.

Good of the Town

Highway Superintendent Andy McGill advised that the trucks and sanders are ready for winter. A new compressor was purchased as the old one ceased up. New wiring was installed in the Town Garage to accommodate this new compressor. One truck is at Albany MAC being fixed. The truck repair should all be covered under warranty. The used fire pump the Town purchased is at Sturdy Supply and Rental being serviced. Bids were received for a new Ford F250 with plow. Bids were received from High Peaks Ford in Ray Brook for $38,276.30 and Bailey Ford in Malone for $36,823.16. These prices are at State Contract Price. A bid was requested from Dannemora Ford but never received. High Peaks Ford bid is for a 2016 truck in stock on the lot. Bailey Ford is for a 2017 truck with an eight to ten week delivery date as they have nothing on the lot. On a motion by Tom Kimpton, seconded by Phil Durkin to accept the bid from High Peaks Ford for a F250 truck with plow for $38,279.16. All members voting Aye. Motion carried.

Resignation from Board of Directors Association of Senior Citizens of Franklin County by Cathy Durkin as of October 31, 2016. On a motion by Dave Perry, seconded by Rick Lyon the Board accepted Cathy Durkin's resignation with regret and thanks. All members voting Aye. Motion carried. If anyone 55 or older from the Town of Santa Clara wishes to fill this spot on this Board, contact Supervisor Webb.

Andy McGill reported that the Town of Santa Clara has 2 open seats on the Franklin County Republican Committee. Any republican residing in the Town of Santa Clara wishing to fill one of these seats please contact Andy.

General Fund vouchers No. 246 to 279 in the amount of $10,955.69, Building Fund vouchers No. 15 to 19 in the amount of $1,385.27 and Highway Fund vouchers No. 92 to 101 in the amount of $8,792.94 were audited by the Board. Motion by Rick Lyon seconded by Tom Kimpton to approve vouchers and pay audited vouchers. All members voting Aye. Motion carried.
