TOWN OF SANTA CLARA PLANNING BOARD MEETINGS

Meeting of the Santa Clara Planning Board held on December 30, 2019

PRESENT: Scottie Adams, John LaHart, Mike Ritchie, Bill Young and Code Enforcement Officer (CEO), Ed Lagree.

ABSENT: Beth Hall (Medical Leave)

The meeting was called to order at 10:00 AM

The first order of business was to approve the minutes of the previous meeting which all received by email. Mike Ritchie move to approve the minutes. John LaHart seconded the motion. All were in favor. The minutes from the Planning Board meeting on 11-05-19 are approved. This meeting was held specifically to address the issue of the subdivision application by Douglas and Pamela Werner that was approved by the Planning Board on April 22, 2014.

This meeting was held specifically to address the issue of the subdivision application by Douglas and Pamela Werner that was approved by the Planning Board on April 22, 2014. The Planning Board Chair received a recent request from the attorney for the Werner's, Ms. Molly Hann, Esq. asking the Planning Board to verify that the Werner property had been legally subdivided according to the TSC Planning Board. The subdivision was approved on 4-21-2014. The minutes for the planning board specified that the subdivision be filed with Franklin County Office of the Clerk within 90 days of the approval. Records indicate that the necessary paperwork was filed in the Franklin County Clerk's office on July 24, 2014 as Plat C-15, map or document number 2014-5002300, 92 days later.

Special Counsel to the Town of Santa Clara for planning and zoning matters, Mike Hill, was consulted concerning this matter. He prepared a resolution for the current Planning Board to consider. The resolution confirms that the subdivision was approved on April 22, 2014 and provides that a new set of identical maps be submitted to the Chair of the Planning Board for proper validation. These new validated maps should then be submitted to the Franklin county clerk's office with in 62 days as specified in the current Land Use Code.

The Planning Board reviewed the original subdivision and minutes from the April 22, 2014 Planning Board meeting. Three of the current Planning Board members were member of the Board in 2014 and were able to provide insight. After discussion, the current board found the subdivision was properly approved in 2014. Bill Young moved that the Planning Board resolution 2019-1, as provided by special counsel, be approved. Mike Ritchie seconded the motion. There was no further discussion. Results of the roll call vote were:

The resolution (below) was unanimously approved by the four members in attendance.

Chair Scottie Adams will provide Counsel, Mike Hill with a copy of the approved resolution with instructions for him to contact Ms. Hann and provide her with the resolution. The Chair will prepare the minutes of the meeting for distribution to Board members before they are posted on the Town of Santa Clara Web site.

Mike Ritchie moved that the meeting be adjourned. John LaHart seconded the motion. All were in favor. Meeting was adjourned 10:15 AM.

Note: Ms. Hann arrived shortly after the meeting had been adjourned. She was delayed by the hazardous road conditions caused by an ongoing ice storm.

RESOLUTION OF THE TOWN OF SANTA CLARA PLANNING BOARD CONFIRMING 2014 APPROVAL OF SUBDIVISION OF CERTAIN LANDS OF DOUGLAS and PAMELA WERNER

WHEREAS, Douglas and Pamela Werner have requested, through their attorney, Molly Schubert Hann, Esq., confirmation of the Town's approval, in 2014, of the two-lot subdivision of certain lands owned by the Werners, said lands being more fully depicted and described in the subdivision map prepared by Stacy L. Allott, L.S. of Geomatics Land Surveying, P.C., and dated December 11, 2013, last revised February 11, 2014, and filed in the Franklin County Clerk's office on July 24, 2014 as Plat C-15, map or document number 2014-5002300, and

WHEREAS, on this date the Planning Board has reviewed the file and record of the Werners's application for the above-referenced subdivision and of the Planning Board's review of such application at its meeting held on April 22, 2014, and

WHEREAS, on this date the Planning Board has also reviewed the above- referenced filed subdivision map, NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING BOARD OF THE TOWN OF SANTA CLARA, FRANKLIN COUNTY, NEW YORK, AS FOLLOWS:

The Planning Board hereby confirms that the above-referenced subdivision was approved by a unanimous vote of the Town of Santa Clara Planning Board on April 22, 2014, and The current Planning Board considers the two-lot subdivision to have been approved and filed in 2014, consistent with the intent of the Planning Board members who approved it at that time, and The Planning Board hereby authorizes its Chairperson, or any Member of the Planning Board designated and authorized by the Chairperson, to stamp and sign, in accordance with current practices of the Planning Board, a supplemental map of the above-referenced subdivision; reflecting the approval date of April 22, 2014; for prompt filing and recording by the Werners or their attorney in the Franklin County Clerk's Office.

This Resolution shall take effect immediately.

The question of the adoption of this Resolution was duly put to a vote on roll call which resulted as follows:
