PRESENT: Board Members: John LaHart, Bill Young, Mike Ritchie, Beth Hall and Code Enforcement Officer, Ed Lagree.

The meeting was called to order at 11:00 AM.

The first order of business was to elect a temporary Vice Chair to take the place of Chair Scottie Adams in her absence. John Lahart was unanimously elected to be Vice Chair of the Planning Board.

Site Plan Application:

LOCATION:: 148 Moss Rock Road, Upper Saranac Lake

The applicant had previously requested to build a boathouse and dock. The boathouse project was approved by the Planning Board on 9-18-18. At that time, Kevin Smith, the owner verified that the current dry boathouse and dock would be removed. Subsequently the original boathouse application was rejected by the NYSDEC because there was no wet slip with direct access to the water. A revised plan approved by the NYSDEC was submitted to the CEO by Michael Bird, the architect, but never submitted to the Planning Board.

The newest application would renovate the current dry boathouse. The applicant supplied the Planning Board with a picture of the current dry boathouse and a picture of the proposed renovated dry boathouse. Although the applicant stated that the renovated dry boathouse would not exceed the 625 sq. ft. limit for boathouses in the Land Use Code, no measurements were supplied. Additionally, the renovated boathouse includes docks for which no dimensions were provided. Also, there are other docks on the property that must be included in the total dock limit and the total boathouse/dock combined limit. It is not possible for the Planning Board to approve the application without more information.

Bill Young moved that the application be rejected until a proper application is submitted: Dimensions of new boathouse, dimensions of all docks on the property, survey of the property showing current dock locations, property deed, APA and DEC jurisdictional rulings or applications. John LaHart seconded the motion. All were in favor. Motion passed.

LOCATION:: 197 Fish Creek Park Road, Fish Creek

The applicants request to replace an existing dock with a dock with a new boathouse and dock. The plans show a boathouse that is 10 ft. wide and projects 22 ft. from the shoreline for a total area of 352 sq. ft. The boathouse is one story, with a maximum height of 8 ft. A dock/walkway runs along one side of the boathouse and is 4 ft. wide and 22 ft. long for at total area of 88 sq. ft. The combined area of the dock and the boathouse is calculated to be 448 sq. ft. All measurements are with in legal limits defined in Code section 7.35 B and C. The property has 96.4 ft. of waterfront. 15% of 96.4 is 14.46 ft. The combined width of the boathouse and dock/walkway is 14 ft., which meets Code specifications in Section 7.35 A.

The application is thorough and complete. It includes a plan for demolition and site plan work, photographs of the current dock and proposed work area, site plan and survey maps, drawings showing boathouse and walkway (dock) details, the deed to the property, a header of a Town Tax bill to confirm parcel tax ID and location, and notification that they have applied for an APA Jurisdictional Determination.

The application is thorough and complete. Bill Young moved that the Planning Board approve the site plan application for dock removal and replacement with a new boathouse submitted by the Sodells. The motion was seconded by John LaHart. All were in favor. Motion passed.

Other topics:

The subject of dry boathouses was discussed. Dry boathouses are not allowed under the current Land Use Code. However, there are several on Upper Saranac Lake. Because these dry boathouses are pre-existing they could be replaced.

The 10 proposed updates to the Land Use Code, modified by special counsel, Mike Hill were reviewed and discussed. All Board members agreed that the modified updates be submitted to the Town Board for their approval. The approval process should start at the Town Board meeting being held on Wednesday, June 19, 2019.

The Chair will prepare the minutes of the meeting for distribution to Board members before they are posted on the Town of Santa Clara Web site. The site plan applicant will receive an official approval letter defining the Planning Board ruling. The Variance Board will receive a copy of the Planning Board minutes.

John LaHart moved that the meeting be adjourned. Beth Hall seconded the motion. All were in favor. Meeting was adjourned 11:40 AM.
