TOWN OF SANTA CLARA PLANNING BOARD

The meeting was called to order by Chair, Scottie Adams at 2:00 PM.

The main topics for the meeting were two site plan applications.

Miscellaneous Business:

Scottie handed out flyers on the 27th Annual Local Government Conference at SUNY Potsdam to the Board members.

Mike Ritchie moved that the minutes of the previous Planning Board meeting be approved. Beth Hall seconded the motion. All voted in favor of the motion.

Site Plan Application:

APPLICANT: Michael Bird, Adirondack Design for Kevin Smith, owner

LOCATION: 148 Moss Rock Road, Upper Saranac Lake

The applicant requests to build a boathouse and dock. The boathouse projects approximately 22 ft. 7 in from the shoreline and is 31 ft. 4 in. wide for a total area of 625 sq. ft. The boathouse is one story, 15 ft. high. The dock is on the front of the boathouse and is 31 ft. 4 in. wide and approximately 5 ft. 4 in. in depth for at total area of 249 sq. ft. The combined area of the dock and the boathouse is 874 sq. ft. Section 7.35 of the Town of Santa Clara Land Use Code specifies maximum limits of a length of 30 ft., maximum height of 15 ft., a boathouse of 625 sq. ft., a dock of 500 sq. ft. and a total for dock and boathouse of 875 sq. ft. Kevin Smith verified that the current dry boathouse and dock would be removed.

Bill Young moved that the Planning Board approve the site plan application. The motion was seconded by John LaHart. Voting was as follows:

Site Plan Application:

APPLICANT: William C. and Leslie W. Main
PARCEL ID: 473.-1-14
LOCATION: 469 Witchindin Road, Upper Saranac Lake

The applicant requests to build a boathouse and replace the existing dock. The plans show a boathouse that is 30 ft. long but projects 33 ft. from the shoreline. The boathouse is 20 ft. wide for a total area of 600 sq. ft. The boathouse is one story, 15 ft. high. The dock runs along one side of the boathouse and is 8 ft. wide and 33 ft. long for at total area of 264 sq. ft. The combined area of the dock and the boathouse is reported to be 864 sq. ft.

The application includes the APA Jurisdictional Determination, the deed to the property, a map of survey, a site plan map and dock and boathouse details provided by the Dock Doctors.

Section 7.35 of the Town of Santa Clara Land Use Code specifies maximum limits of a length of 30 ft., maximum height of 15 ft., a boathouse of 625 sq. ft., a dock of 500 sq. ft. and a total for dock and boathouse of 875 sq. ft.

Because the boathouse and dock extend greater than 30 ft. from the mean high water mark this boathouse and dock do not meet the requirements in Section 7.35 of the Town of Santa Clara Land Use Code.

Beth Hall moved that the Planning Board DENY the site plan application. The motion was seconded by Mike Ritchie. Voting was as follows:

The site plan application is denied. Two options which are available are: apply for a variance if there are sufficient grounds to justify why the boathouse and dock must extend that far into the lake or modify the boathouse and dock so that they extend no further than 30 ft. from the mean high water mark as proscribed in the Town of Santa Clara Land Use Code.

Other topics

Maps of the two R-C-3.2 areas in the Town that are contained within a single tax property were provided by Michael Martin of Cedar Eden. Maps showed the dimensions as guesstimated when the original map was drawn back in the 1990’s before GIS was available. The dimensions were superimposed on an aerial map of the properties. Using these maps it was possible to adjust the boundary lines so that the entire commercial areas were contained within the R-C 3.2 areas.

The proposed changes to the Land Use Code that the Board has been working on since May were reviewed. The proposed changes will be submitted to the Town Board, hopefully before the next Town board meeting in October.

John LaHart moved that the meeting be adjourned. Beth Hall seconded the motion. All were in favor. Meeting was adjourned 2:32 PM.
