TOWN OF SANTA CLARA BOARD MEETINGS

Minutes of the Public Hearing, Organizational Meeting and a Regular Monthly Meeting of the Santa Clara Town Board held on Thursday, January 14, 2021 via Zoom due to Covid-19, at 6:00 P.M.

Public Hearing called to order by Supervisor McGill at 6:00 P.M.

The purpose of the Public Hearing was to continue the Public Hearing on proposed Local Law No. 01 of 2021. Additional written comments were accepted until 5:00 PM on January 7, 2021. Additional spoken comments from any person wishing to speak will be heard by the Town Board beginning at 6:00 PM on January 14, 2021.

Written comments were received and provided to the Town Board from the following, Marc Gitlitz, Charles and Joan Bechtel, Charlie and Debbie Muller, Upper Saranac Lake Association, and Philip Forlenza. Oral comments were received during the public hearing from John LaHart, Charles Bechtel, Dave Powalyk and Matt Norfolk.

The language in the current Local law 01-2021 was updated in the section 3 to "Development" means any man-made change to improved or unimproved real property including, but not limited to, construction or expansion of buildings or other structures, mining, dredging, filling, paving, grading, excavation, extensive clearing of vegetation, drilling operations or storage of equipment or materials. In-kind repairs to, or re-construction of, an existing building or structure on the same footprint or foundation, which do not increase the surface area, footprint, height or volume of the building or structure and do not change its use, do not constitute "development for purposes of this definition.

After further discussion on a motion by Rick Lyon, seconded by Dave Perry the Board on a roll call vote authorized Mike Hill, Special Counsel, to update the Local Law #01-2021 to include language prohibiting shipping containers and new construction materials.

Local Law 01-2021 now reads for section 3

3. Definitions

"Commercial Use" means any use involving the sale or rental or distribution of goods, services or commodities, either retail or wholesale, or the provision of recreation facilities or activities for a fee.

"Development" means any man-made change to improved or unimproved real property including, but not limited to, construction or expansion of buildings or other structures, mining, dredging, filling, paving, grading, excavation, extensive clearing of vegetation, drilling operations or storage of shipping containers or of construction equipment or building materials for construction of, or expansion of, buildings or structures. Routine maintenance of and in-kind repairs to, or re-construction of, an existing building, structure or other improvement on the same footprint or foundation, which do not increase the surface area, footprint, perimeter, height or volume of the building, structure or other improvement and do not change its use, do not constitute "development" for purposes of this definition and Local Law. Building Permit requirements would still apply.

"Moratorium Area" means the Town's R-C-1.3 and R-C-3.2 zoning districts.

And Section 7

7. Termination - This moratorium may be terminated earlier than June 30, 2021 upon enactment of local legislation regulating Development in the Moratorium Area, or otherwise in the discretion of the Town Board.

On a motion by Dave Perry, seconded by Mickey Webb

I hereby move as follows:

That we continue the Public Hearing on the proposed Moratorium Law, incorporating the revisions that we discussed tonight, to our next scheduled Town Board meeting on February 11, 2021, at 6:00 PM, and

That the proposed Moratorium Law, incorporating the revisions that we discussed tonight, be posted on the Town's website as soon as possible, and

That we hereby refer the proposed Moratorium Law, incorporating the revisions that we discussed tonight, to the Town Planning Board for its review at its meeting this month, with the request that the Planning Board provide any comments it may have as soon as possible following its meeting.

That any comments of the Planning Board be posted on the Town's web site and at Town Hall as soon as possible after receipt, and that paper copies of such comments be made available as soon as possible to the public at Town Hall during normal business hours, and

That any public comments on the proposed revised Moratorium Law be limited to the proposed revisions regarding repairs and to any recommendations made by the Planning Board, and

That the deadline for receipt of written public comments will be February 5, 2021 at 5:00 PM, at Town Hall,

That only spoken comments, limited to the proposed revisions regarding repairs and to any recommendations made by the Planning Board, will be accepted at the continued Public Hearing on February 11, 2021, beginning at 6:00 PM.

Regular monthly meeting called to order by Supervisor McGill.

Motion by Mickey Webb, seconded by Rick Lyon to dispense with the reading of the minutes of the previous meeting. All members voting Aye. Motion carried. Motion by Dave Perry, seconded by Rick Lyon to accept the minutes. All members voting Aye. Motion carried.

Resolution No. 02 - Introduced By: Mickey Webb seconded By: Dave Perry

RESOLUTION APPROVING PROPOSAL OF THE CHAZEN COMPANIES TO PROVIDE THE TOWN WITH PLANNING AND ZONING SERVICES FOR DEVELOPMENT OF MARINA REGULATIONS

WHEREAS, the Town Board believes it would be prudent and beneficial to engage an experienced professional planning and zoning consultant to assist the Town in developing marina regulations to be incorporated into the Town's Land Use Law, and
WHEREAS, the Town Board has received and reviewed a proposal from The Chazen Companies for such professional services,
NOW, THEREFORE, THE TOWN BOARD OF THE TOWN OF SANTA CLARA HEREBY RESOLVES AS FOLLOWS: The Town hereby approves the professional services proposal from the Chazen Companies bearing a revised date of January 4, 2021, for planning and zoning services to assist the Town in developing marina regulations, for an estimated cost of $5,950. Any additional services beyond the scope of the proposal shall require prior authorization by the Town and will be billed on a time and materials basis at an hourly rate of $165. The Supervisor is hereby authorized to sign the professional services proposal from the Chazen Companies on behalf of the Town and to ask the Chazen Companies to begin work as soon as possible.

This Resolution shall take effect immediately.

The question of the adoption of this Resolution was duly put to a vote on roll call which resulted as follows:

The Resolution was declared duly adopted by the Town Board this 14 day of January, 2021.

Regular board meetings for February 2021 will be February 11, 2021 immediately following the Public Hearing. Maybe held by Zoom. If so the sign in information will be on the Town Webb Site.

Good of the Town

Scott LaMay Highway Superintendent reported everything is going well in the Highway Department. The Department is keeping up with the roads and have had no breakdowns other than a few minor pickup plow issues. Keeping up with truck inventory, it is time to think about selling the 2010 International and replacing it with a single axel. The truck has had a lot of wear and tear and it is only a matter of time before the department can't trust it anymore. Scott would replace it with a carbon copy of the 2016 Western Star single axel the Town already has. Town of Waverly is doing a great job with plowing the Hamlet.

On a motion by Mickey Webb, seconded by Dave Perry a Special Committee will be formed to work with the Chazen Comp. on the new Marina Regulations. The committee would consist of the Code Enforcement Officer, 2 Town Board members, 2 Planning Board members and 2 Variance Board members. All members voting aye. Motion carried.

Town Board members to be on the Special Committee will be Rick Lyon and Mickey Webb. Supervisor McGill will contact the Planning Board and Variance Board to identify their 2 members each that will be on the committee.
