Minutes of the Public Hearings and Regular Monthly Meeting of the Santa Clara Town Board held on Thursday, October 8, 2020, Saranac Inn, NY Town Hall at 6:00 P.M.

Regular monthly meeting called to order by Supervisor McGill at 6:30 P.M.

Public Hearing Called to order by Supervisor McGill at 6:00 P.M. on the Preliminary Budget of the Town of Santa Clara for the fiscal year beginning January 1, 2021. A copy of it is available at the office of the Town Clerk at the Santa Clara Town Hall, 5367 State Route 30, Saranac Inn, NY, where it may be inspected by any interested person during office hours.

Pursuant to Section 108 of the Town Law the following proposed salaries of the following Town Officials are specified in said Preliminary Budget:

Supervisor: $21,035.00
Councilman (4): $3,411.50 each
Town Clerk: $12,697.00
Tax Collector: $3,964.00
Town Highway Superintendent: $53,160.00
Town Justice: $4,987.00

Due to the incorrect copy of the budget being posted on line, correct copies where available and the website has been updated. The lines items affected were:

All those wishing to make oral or written comments having been heard, the Public Hearing was adjourned at 6:13 P.M. on the motion of Rick Lyon, seconded by Dave Perry. All members voting Aye. Motion carried.

Public Hearing Called to order by Supervisor McGill at 6:15 P.M. on the proposed new fire protection contract with the Paul Smiths-Gabriels Volunteer Fire Department Inc. The terms of the proposed contract include that the said Fire District shall answer and attend upon all calls for emergency fire protection in the Town of Santa Clara Fire Protection District 2; that the contract term shall be for a period of five (5) years commencing January 1, 2020 and terminating December 31, 2025; and that the amounts to be paid by the Town of Santa Clara to the Paul Smiths-Gabriels Volunteer Fire Department for providing such fire protection shall be: $6,592.00 for the year 2020, $6,790.00 for the year 2022, $6,993.00 for the year 2023, $7,204.00 for the year 2024 and $7,420.00 for the year 2025.

All those wishing to make oral or written comments having been heard, the Public Hearing was adjourned at 6:26 P.M. on the motion of Rick Lyon, seconded by Dave Perry. All members voting Aye. Motion carried.


Regular monthly meeting called to order by Supervisor McGill at 6:30 P.M.

Pledge of Allegiance to the flag of the United States of America

Motion by Rick Lyon, seconded by Mickey Webb to dispense with the reading of the minutes of the previous meeting. All members voting Aye. Motion carried. Motion by Mickey Webb, seconded by Rick Lyon to accept the minutes. All members voting Aye. Motion carried.

Resolution No 8- Paul Smiths-Gabriels Fire Department Inc. Contract

New fire protection contract with the Paul Smiths-Gabriels Volunteer Fire Department Inc. The terms of the proposed contract include that the said Fire District shall answer and attend upon all calls for emergency fire protection in the Town of Santa Clara Fire Protection District 2; that the contract term shall be for a period of five (5) years commencing January 1, 2020 and terminating December 31, 2025; and that the amounts to be paid by the Town of Santa Clara to the Paul Smiths-Gabriels Volunteer Fire Department for providing such fire protection shall be: $6,592.00 for the year 2020, $6,790.00 for the year 2022, $6,993.00 for the year 2023, $7,204.00 for the year 2024 and $7,420.00 for the year 2025.

On a motion by Mickey Webb, seconded by Rick Lyon the Board approved the 5 years contract for fire protection from Paul Smiths-Gabriels Fire Department Inc.

On a Motion by Mickey Webb, seconded by Rick Lyon the Board move to go into Executive Session to discuss potential litigation at 6:35 P.M. All members voting Aye. Motion carried.

On a Motion by Mickey Webb, seconded by Dave Perry the Board returned from Executive Session at 6:50 P.M. All members voting Aye. Motion carried.

RESOLUTION AMENDING RESOLUTION # 06 of 2020 SCHEDULING PUBLIC HEARING ON A LOCAL LAW TO ESTABLISH A MORATORIUM ON COMMERCIAL DEVELOPMENT IN THE R-C-1.3 and R-C-3.2 ZONING DISTRICTS IN THE TOWN OF SANTA CLARA
WHEREAS, at a meeting held on September 10, 2020, the Town Board duly adopted Resolution #06 of 2020 scheduling a Public Hearing for November 12, 2020, on a Local Law to establish a moratorium on commercial development in the Town's R-C 1.3 and R-C 3.2 Zoning Districts, and WHEREAS, the Town Board wishes to postpone the Public Hearing to its meeting in December in order to allow more time for preparation and review of the required draft local law, NOW, THEREFORE, THE TOWN BOARD OF THE TOWN OF SANTA CLARA HEREBY RESOLVES AS FOLLOWS:
1. The Public Hearing on a Local Law to establish a moratorium on commercial development in the Town's R-C 1.3 and R-C 3.2 Zoning Districts is hereby postponed and re-scheduled to 6:00 PM on December 10, 2020.
2. The other provisions of Resolution #06 of 2020 are hereby affirmed, though their implementation may be delayed, as applicable and appropriate, consistent with the postponement of the Public Hearing.
3. This Resolution shall take effect immediately. The question of the adoption of this Resolution was duly put to a vote on roll call which resulted as follows:

The Resolution was declared duly adopted by the Town Board this 8th day of October, 2020.

Supervisor McGill has a quote from Friends Commercial Contracting to replace some of the fascia board on the Town Hall. The weather has damaged a portion of the boards and they need to be replaced at a quote of $3,900.00. On a motion by Rick Lyon, seconded by Mickey Webb the Board approved the quote from Friends Commercial Contracting. All members voting Aye. Motion carried.

Supervisor McGill has requests for funding from St Regis Falls Adult Center and North Country Life Flight for the year 2021. The requests have already been allotted for in the 2021 Town Budget.

Next Board Meeting will be November 12, 2020 at 6:30 P.M. Public Hearing will be held on November 12, 2020 at 6:15 P.M. on the proposed Saranac Lake Volunteer Rescue Squad contract for 2021.

Open Discussion

John LaHart inquired if there was an update from the Town Attorney on the Local Leash Law. The Town Attorney has reviewed the current Leash Law and finds the law well established. He sees no need for change. He states that the current law cannot be enforced by the dog control officer, the law enforcement officers or the Town Court unless a complaint is signed. The Town Attorney advised that if the public feels changes need to be made that they should send a letter to the Town with the proposed changes. The Town will have the Town Attorney review them to see if the proposed changes are legal and enforceable. At this time the Local Leash Law will not be amended.

John LaHart as a representative for the Town Planning Board asked if the Town would speak to special counsel on the short term rental regulations that the Planning Board has proposed. Counsel has had them for review and the Planning Board wants to know where he stands on reviewing them.

Good of the Town

Scott LaMay provided a report that the Highway Department has started to saddle up the plow trucks. Franklin County has been notified again about objects being put out for sale or free at the end of County Route 46. The County advised that they would have signs made up stating that this would no longer take place. Scott advised the permit has been granted for the work that has to be done on the Everton Road culvert. The window to do the project has sense past for the Town and DEC so the permit will be dated next summer. The Highway Department projects for this fall include trimming trees, raking the dirt roads and making sure the department is ready for this winter.

General Fund vouchers No. 204 to 222 in the amount of $4,856.68 and Highway Fund vouchers No. 91 to 101 in the amount of $121,551.98 were audited by the Board. Motion by Dave Perry seconded by Mickey Webb to approve vouchers and pay audited vouchers. All members voting Aye. Motion carried.
