Meeting of the Santa Clara Planning Board held on May 24, 2021
PRESENT: Board Members: Scottie Adams (via speakerphone), Mike Ritchie, Beth Hall, John LaHart and Code Enforcement Officer, Ed Lagree. Also present was Upper Saranac Lake Manager, Guy Middleton.
ABSENT: Bill Young
The meeting was called to order by Chair, Scottie Adams at 9:00 AM
The first order of business was to approve the minutes of the previous meeting which all received by email. John LaHart moved to approve the minutes. Mike Ritchie seconded the motion. All members were in favor. The minutes from the Planning Board meeting on 05-18-2021 are approved.

The revised application for the boathouse which was previously approved on 3/30/2021 has been reviewed by Planning Board members. Mike Ritchie moved to approve the revised application. The motion was seconded by John LaHart.

Motion to approve the revised application was passed.
The chair will notify the applicants of the approval of their application.
The problem of the DEC policy that all boathouses be a minimum of 5 ft. from the shoreline will need to be addressed. Repeated attempts to request documentation from the DEC specifying this policy have been unsuccessful. Perhaps a legal approach can be pursued. If a definitive policy can be obtained from the DEC, then the Planning Board could consider revising their boathouse/dock regulations to take this policy into account.
Proposed Moratorium Extension in R-C 1.3 and R-C 3.2 Zoning Districts
Proposed Local Law No. 02 would extend an existing moratorium from June 30, 2021 to December 31, 2021, on commercial development within the R-C 1.3 and R-C 3.2 zoning districts in the Town of Santa Clara for the purpose of allowing time for the Santa Clara Town Board to develop and enact new regulations governing commercial development in those zoning districts. The Town Board opened a Public Hearing on the proposed extension on May 13, 2021. The Town Board received one letter of opposition from Norfolk Law PLLC on behalf of USL Marina LLC. One letter in support was received from the Upper Saranac Lake Association.
Planning Board members had the opportunity to read the Town Board meeting minutes from May 13, 2021, concerning the original draft Local Law to extend the moratorium. The minutes included the public comments expressed in the letters received. The Planning Board members received the updated draft Local Law to extend the moratorium, prepared after the May 13th Town Board meeting. The updated draft included revisions discussed during the May 13th meeting.
After discussion, the Planning Board members in attendance agreed that the Town Board should move forward by voting on the revised draft Local Law to extend the moratorium at their June 17, 2021 meeting. Approving the revised draft Local Law to extend the Moratorium seems the best way to ensure forward progress considering that the Special Committee is close to finalizing a draft of commercial marina regulations.
John LaHart made a motion that the Planning Board recommend the Town Board move forward by voting to approve the revised draft Local Law to extend the moratorium at their June 17, 2021 meeting. The motion was seconded by Mike Ritchie.

Chair Scottie Adams will provide the Town Clerk with a copy of these meeting minutes from 05-24-2021 for her to forward to Town Board members before the next Town Board meeting on 06-17-2021.
The next meeting will be held on Monday, June 7, 2021 at 9 AM at the Town of Santa Clara Town Hall.
John LaHart moved that the meeting be adjourned. Beth Hall seconded the motion. All were in favor of the motion. Meeting was adjourned 9:15 AM.
