The Variance Board of the Town of Santa Clara, County of Franklin, State of New York held a Public Hearing on Tuesday, August 24, 2021, at 7:00 PM at the Santa Clara Town Hall, Route 30, Saranac Inn, New York, to hear comments on the following application:
Application of Daniel Rockey would require an area variance to allow for new boathouse and dock structure which would have a combined square footage that exceeds that allowed in the Santa Clara town use code.
The proposed variance is:
Seeking approval to construct a boathouse and dock structure that exceeds the maximum total area allowed of 875 sq ft under the Santa Clara Town Land Use Code Section 7.35. The dimensions of the boathouse and dock are 46 ft wide, 15 ft tall and 30 ft in depth extending into the lake. The total area of the boathouse and dock, including stairs and ramps is 1481 sq ft. The total area when including an existing dock on an adjacent lot is 1603 sq ft.
The Variance Committee Members having taken into consideration the benefit to the applicant, as weighed against the detriment to the health, safety and welfare of the neighborhood or community and having considered the five factors, has decided to DENY the variance. The decision does not preclude on our part any APA or other authoritative approval. It is the responsibility of the applicants or owners to contact other state, county and/or local agencies to secure any necessary permits.
